Kerala Patent Support Scheme :- As part of the Kerala Startup Mission the Kerala government offers this  Patent Support Scheme. Businessmen, students and entrepreneurs who are successful in obtaining a patent are eligible to receive financial assistance under this scheme. The Kerala Startup Mission is a new instrument the government has created to aid in the development of entrepreneurship and development activities in the state. Additionally, it is responsible for creating the KSUM Patent Support Scheme which is the full name of the patent support scheme.In this article, we will discuss all the important points such as objectives and eligibility criteria of the scheme. The participants of the new initiative would mostly be those who live in Kerala. By offering payment for the cost of getting a patent, which will include the consultation fee up to a maximum of Rs. 2 lakh for each Indian patent that is awarded, the Patent Support System aims to assist startup entrepreneurs and student entrepreneurs. For successfully prosecuted applications for foreign patents in a single area of interest up to Rs. 10 lakh would be paid.There will be three processes for submitting, prosecuting and giving the refund.

Entrepreneurs and student innovators that meet the eligibility requirements can submit their applications online through the Kerala Patent Support Scheme portal. Registration will be accessible on each day. Applications received before the twentieth of every month will be processed within that month those received after the 20th will be carried over to the next month to be processed.

  • Offering Rs. 2 lakhs for each Indian patent and Rs. 10 lakhs for each international patent is the scheme’s first and most significant benefit.
  • This service does not apply to the filing of provisional patents, patent searches, draughts, and filings, claim preparations, fast track fees, claim prosecutions or grant activities of prosecution against appellate authorities who have already rejected your claims for valid grounds. Both are not patent extensions.
  • Copyrights, trademarks or any other type of intellectual property right are not supported under the proposal only patents are.

Eligibility Criteria  

The Eligibility Criteria for for this scheme is given below:

  • The candidate must be a permanent resident of Tamil Nadu.
  • The first is the submission date Only patent applications filed after November 9th 2015 will be taken into account.
  • A company or limited liability partnership should be selected as the kind of legal structure for a new company.
  • From the schemes are excluded innovators.
  • If they satisfy the conditions student entrepreneurs can submit a direct application through their IEDC for patent financing.
  • Within ten years of the date of incorporation the new firm must be registered in Kerala and must possess both a DIPP and an Udyog Aadhar number.
  • Financial aid will only be available to students who are actively pursuing their academic objectives.
  • The scheme doesn’t offer financial support for renewing patents.
  • Legal proceedings brought against judicial review bodies that have previously rejected a person’s patent claims are not financially supported by the scheme.

  • The startup requires a NOC from the original inventor to pay the cost of the patent if the original inventor donates technology to the startup.
  • The costs of the patent are reimbursed to startups who use the filed patent concept or technology to create their businesses if the patent is filed before the firm is founded or registered.

  • An original, signed and sealed hard copy of the invoice and receipt for the consultation fees and IPR payments from IPR India.
  • The verified copy of the original bank statement which also includes the money transfer statement.
  • A letter from the IEDC endorsing the proposal and attesting to its legitimacy.
  • A succinct breakdown of the principles or claims that are patentable a copy of the certificate for the provisional patent if any.
  • In the case that a patent is secured, a patent certificate.
  • Copies of the patent application early publication, early review, modifications to the initial application or an IPR receipt are all acceptable evidence.
